Terms of sale

1. Purpose

These terms govern the sale of credits on the site https://verbacount.com, a service operated by 9577-7983 Québec inc. (the "provider"). One credit generates one set of slides: images in the 1080 × 1350 format showing how often words chosen by the customer are said in the videos of YouTube channels chosen from the site's catalogue.

2. Prices

Credits are sold in packs, paid for once, with no subscription. One generation costs one credit.

The currency of the price depends on the country the customer visits the site from: the euro in the euro area, the pound sterling in the United Kingdom, the Canadian dollar in Canada, the US dollar everywhere else. Prices in euros and in pounds sterling include taxes: the customer pays the amount shown. To prices in dollars any sales tax due is added at payment. In other countries the payment page may convert the price into the customer's currency. The prices that apply are those shown when the order is placed.

3. Order and payment

Orders are placed from the "Credits" page, after signing in. Payment goes through Stripe Managed Payments: the merchant of record is Sold through Link, LLC, an affiliate of Stripe, which shows the payment page, takes the payment, and issues the receipt and the invoice in its own name; the service is provided by 9577-7983 Québec inc.. On the bank statement the purchase shows under a label beginning with "LINK.COM*". Payment is due at once and is made by card or by the other means offered on the payment page. Credits are added to the account as soon as the payment is confirmed.

Account. Signing in to the account is done with a link sent by email or, if the customer chose one, with a password. A customer who chooses a password is responsible for keeping it confidential. The customer may also turn on two-step verification; if they lose their phone and their backup codes, the seller may turn it off after checking that the request really comes from them, and tells them so by email.

4. Credits and slides

Credits do not expire. A credit is only used when a set of slides has been generated successfully: a generation that fails costs nothing. Generated slides remain downloadable from the customer's account. A free preview can be asked for before any purchase. The free preview shows the slide set with invented figures and episode titles, and a watermark; only the set bought holds the real results.

Referrals. Each customer has an invitation link. When a person who has no account yet creates one through that link, or a person who has bought nothing yet types that link's code on their "Credits" page, and then buys their first pack, they and the customer who invited them each receive, depending on that first pack: 2 credits for a pack of 10, 8 credits for a pack of 50, 10 credits for a pack of 200. These credits are given once, when that first pack can no longer be refunded (section 5). They are offered: they are not refunded, not exchanged for money, and are used before the credits of packs. The seller may end the program or change its terms for the future; credits already given are kept. A referral obtained by fraud, for instance through accounts made for oneself, may be cancelled.

5. Cancellation and refunds

A pack none of whose credits has been used is refunded in full, on request, within 14 days of the purchase. As soon as one credit of a pack has been used, that pack can no longer be refunded. A credit used is taken from the oldest pack that still holds some; the "Credits" page says, for each pack, whether it can still be refunded. Refunding a pack takes that pack's credits off the account.

If a generation fails, or if its result is unusable through the provider's fault, the credit is given back to the customer's account. This is a credit given back, not a refund in money.

The merchant of record being Sold through Link, LLC (Stripe Managed Payments), it is Link that handles refund requests and applies the cooling-off periods the law requires. The request is made to Link's support, from the purchase's receipt, or through the contact form.

These rules add to the rights the law gives the customer in their country and do not limit them.

6. Nature of the statistics

The figures are produced automatically from the subtitles published on YouTube, often made by speech recognition, as of the date shown on each set of slides. They may contain errors, transcription errors in particular. The method is described on the last slide of each set. They measure how often words are said and say nothing of the channels' intentions.

7. Use of the slides

The customer may publish, share and use the slides they generated, including for professional purposes, provided they do not alter them in a way that distorts their meaning. They alone are responsible for publishing them and for what accompanies them. Reselling the service or the credits is not allowed.

8. Liability

The provider makes reasonable efforts to keep the service available, without being able to guarantee it without interruption. Its liability is limited to the amount paid by the customer for the order concerned, save for gross negligence or bodily injury.

9. Complaints

Any complaint may be sent through the contact form.

10. Governing law

These terms are governed by the laws of the province of Québec and the federal laws of Canada that apply there. Any dispute falls under the courts of the judicial district of Montréal. These choices do not deprive the consumer of the protection given by the mandatory provisions of the law of their country of residence, nor of their right to bring a case before the courts of their home when that law allows it.

Should the versions differ, the French version prevails.
